			<content:encoded><![CDATA[<p>Capital tax allowances are allowances on fixed assets a business may claim as a deduction from net profit to arrive at the net taxable profit. If a taxi driver does not claim the correct capital tax allowances in the taxi accounts that net taxable profit and the income tax and national insurance payable will be higher than it need be. Hard cash lost to the government that they are not entitled to, your cash.</p>
<p>A fixed asset is typically a piece of kit purchased by a business that will be used by that business to generate a profit over a period of time, perhaps more than one year, as opposed to an item that is consumed within the financial year. Items in the category of fixed assets may be plant and machinery, fixtures and fittings, computers and vehicles.</p>
<p>For most fixed assets the capital tax allowance consists of an enhanced first year allowance in the year of purchase and writing down allowance in subsequent years. This type of tax allowance spreads the allowance of the amount spent over the life of the asset rather than that item being expensed in full in the year the purchase was made.</p>
<p>For small businesses the first year allowance is currently 50%, 2007-08 and in subsequent years the writing down allowance is 25% of the balance. Special rules apply to vehicles and of particular interest when preparing the taxi driver accounts. These special rules certainly affect taxi drivers many of whom will find they are not eligible to claim the 50% first year allowance on their taxi.</p>
<p>Vehicles, including taxis are generally excluded from the 50% first year allowance and may not be claimed in the taxi driver accounts. In addition the 25% writing down allowance is restricted to a maximum of 3,000 pounds p.a. The writing down allowance continues until the value of the vehicle is written off for tax purposes or is sold.</p>
<p>When a vehicle is sold if the vehicle is sold at a price below the written down value for tax purposes then an additional capital tax allowance can be claimed in the taxi driver accounts. The additional tax allowance is equal to the difference between the price at which the vehicle was sold and the net written down value for tax purposes. When a vehicle is sold at a price above the net written down value for tax purposes there is a deduction in the capital allowances which is called a balancing charge and is equal to the sales value less the written down value for tax purposes.</p>
<p>Commercial vehicles are treated differently to cars. First year allowances can be claimed against the purchase price of vans that are deemed to be commercial vehicles. The Inland Revenue website has a list of vans it deems to be a commercial vehicle and the make and model of any van thought by the owner to be a commercial vehicle should check that vehicle against the list when claiming a first year allowance.</p>
<p>The writing down allowance on commercial vehicles is not restricted to 3,000 pounds. Capital tax allowances on commercial vehicles is then the same as a typical piece of plant and machinery whereby a 50% first year allowance can be claimed in the first year with a 25% writing down allowance in subsequent years.</p>
<p>The capital allowances act 2001 makes a distinction between cars and qualifying hire cars. Cars are subject to the restrictions on capital tax allowances applied to vehicles while qualifying hire cars are not subject to these restrictions in a similar way to which qualifying vans, commercial vehicles are treated.</p>
<p>The definition of what constitutes a qualifying hire car as opposed to a car is crucial to taxi drivers when the taxi driver accounts are being prepared either by the taxi driver or the taxi accountant. Simply using a car solely as a taxi is not sufficient to avoid the capital allowance restrictions. Using a vehicle which is deemed to be a qualifying hire vehicle is sufficient to allow a first year allowance and unrestricted writing down allowances to be claimed in the taxi accounts</p>
<p>To comply with the definition of a qualifying hire car the vehicle must be of a type that is not commonly used as a private vehicle and would also be unsuitable for use as a private vehicle. Hackney carriages, black cabs and limousines fall into the category of a qualifying hire car and taxi drivers using these types of vehicle may claim the 50% first year allowance and the 25% writing down capital allowance in subsequent years in the taxi driver accounts.</p>
<p>Other vehicles used as taxis would not receive the first year allowance but would be subject to writing down allowance of 25% of the original cost in the first year and a further 25% in succeeding years all subject to a maximum of 3,000 pounds per vehicle per annum. In addition when preparing the taxi driver accounts taxi drivers should note that if the taxi is also used for personal use then a further deduction in tax allowances is applicable according to the percentage that the taxi is used for personal business.</p>

<p>Other contributing factors to taxi accidents are improperly maintained vehicles, incompetent and not properly trained taxi drivers, defective engines, imprudence of other drivers, driving under the influence of alcohol, drivers fatigue, bad road and poor weather conditions.</p>
<p>Duties of Taxi Drivers</p>
<p>The state requires cab drivers to take extra care and be more cautious while driving at road since they are carrying passengers. It is their duty to secure their safety.</p>

As a minibus driver you are ultimately responsible for your passengers safety and the safety of other road users.</p>
<p>1. If your minibus is fitted with a microphone do not use it while the vehicle is moving, unless in an emergency.</p>
<p>2. Do not use a mobile phone. It is now illegal to use a hand held mobile phone or similar device when driving in the UK. It is not illegal to use a mobile phone earpiece or a speaker system but this is not advisable. The police can still prosecute a driver if they are not in proper control or driving carelessly whilst using the phone.</p>
<p>3. Do not engage in conversation with your passengers unless it is a short statement to inform them of safety issues, operational matters or the vehicles location.</p>
<p>4. Ensure your passengers behaviour does not endanger other road users or the safety of your vehicle. Do not allow anything to be thrown out of the windows. Advise passengers to stay seated and do not allow running in the aisle. Try to prevent boisterous behaviour and prevent passengers distracting you whilst driving.</p>
<p>5. Allow sufficient stopping distance from the vehicle in front. The stopping distance in a minibus is far greater than that of a car. Remember to add your reaction time to that stopping distance. Extra care needs to be taken when travelling at speed on a motorway or in wet conditions.</p>
<p>6. Brake firmly only when travelling in a straight line. Braking on corners will cause instability. Reduce the minibuss speed before cornering. When descending a steep winding hill, brake firmly on the straights and ease off on the bends.</p>
<p>7. If taking children to school in a minibus with a passenger capacity of 8 or more, it is obligatory to display the 2 yellow retro-reflective warning signs bearing the symbol of 2 school children.</p>
<p>8. When driving on a motorway try to stay in the left hand lane. A minibus can use the fast lane of a motorway to overtake only if its gross weight does not exceed 7.5 tonnes.</p>
<p>9. Do not use your minibus horn when reversing unless there is danger to a pedestrian or another moving vehicle.</p>
<p>10. Do not park your minibus so that it may cause an obstruction to others. If parking at night, the vehicles side and rear lights must be left on. It must always be parked on the nearside of the road unless in a designated parking space.</p>

<p>QUESTION:   If the Law is truly an Ass, does that mean Limousine Companies are Donkeys.</p>
<p>OUR OPINION: &#8220;UK Minibus Legislation is more than 10 Years Out of Date, the EC is still trying to fit a Round Peg into a Square Hole&#8221;.</p>
<p>1. Any vehicle with more than 8 seats is classified as a Minibus since 1986. Thousands of Limousines have up to 16 seats, they are clearly not Minibuses.</p>
<p>2. A Minibus must have a COIF certificate to be legally allowed to carry fare-paying passengers. The UK Authorities responsible for this will not issue any COIF certificate for 99.999% of Limousines in the UK.</p>
<p>3. The vast majority of Minibuses in the UK now have to have a Tachograph fitted. We have been advised that they still have not designed a Tacho that will fit onto all Limousines, and when they are fitted they do not even have to be switched on for Private Use.</p>
<p>4. Minibus Legislation allocates 40cm per Person for room to sit.  That&#8217;s fine for sardines, but would you like to pay hundreds of pounds for a Limousine and then sit cross-legged and sweating away in a 40cm space.</p>
<p>5. Many Local Councils have informed their local Limousine Companies that they cannot collect passengers in adjacent areas, ie. in the next Borough  which is sometimes only a very short distance from their registered address. That is classified as Cross Border Hiring which is illegal !</p>
<p>6. In addition the adjacent Local Councils have also informed all Limousine Companies that they cannot register in or out of their area at all and also that they will not licence any Left-Hand Drive Vehicles for Private Hire Purposes anyway. All SuperStretch American Ford &#038; Lincoln Limousines only exist in Left Hand Drive.</p>
<p>7. After all these years the Government is now considering introducing a Special Licence and Compliance Test for Limousines. As of 1st January 2008 this still has not been done.</p>
<p>8. Contract Hire is now being abolished on 28th January 2008. No nationwide system has been created to replace Contract Hire, ie. to allow Bona-Fide Limousine Companies to operate legally in the UK.</p>
<p>9. Thanks to all of the above the only Insurance Company catering for Private Hire for the 16-Seater Limousines has now pulled out of the market. So Bona-Fide Limousine Companies are now having to switch their insurance on to a brand-new scheme, in order to operate legally.</p>
<p>10. Enforcement Officers, when they ruin your Night-Out and make you abandon your Limousine half way through your journey in the middle of nowhere for example at 3am in the morning on your way back from a night-out,  claim it&#8217;s in the interest of Road Safety. All of these Limos have passed Stringent Annual Safety Tests and Monthly Roadworthy Checks in the USA and in the UK and continue to do so today.</p>
<p>Most Enforcement Officers, Council Staff, <a target="_blank" href="http://www.hirelimolondon.co.uk" onclick="pageTracker._trackPageview('/outgoing/www.hirelimolondon.co.uk?referer=');">Hummer Limo</a> Passengers, Limo Drivers, Limousine Companies etc are not aware of the whole of the above Info. But you the Reader are now fully aware, Knowledge is Power. </p>
<p>WHAT  TO  DO  NEXT</p>
<p>So if you wish to book and ride legally in Super-Longbody Limousines and travel with 8 &#8211; 16 passengers on your Special Day Out,  you have TWO  OPTIONS.</p>
<p>OPTION 1:  Is to book two separate 8-seater Limousines to carry your Guests and forget about the Big 16-Seater Super-Longbody Limousines. This however is no fun at all, as your Group is sadly being split into two, so that they cannot travel in a Party Atmosphere or talk to half of their Friends and also it will cost you more to hire TWO Limos instead of one.</p>
<p>OPTION 2:  Is to carry up to 16 passengers in a Single Limousine. The way to do this legally is to book the Limousine from a Limo Rental Company and then separately find a Qualified Professional Driver for your <a target="_blank" href="http://www.hirelimolondon.co.uk" onclick="pageTracker._trackPageview('/outgoing/www.hirelimolondon.co.uk?referer=');">Hummer Limousine Hire</a> independently elsewhere.</p>
